I was speaking at an ACA conference last year when someone asked me "is COBRA dead, now that ex-employees can get exchange or private coverage?" My answer was somewhere between "no" and "not yet," but I recognize that COBRA coverage will accomplish different objectives for ex-employees in the future. EBSA also recognizes that and has proposed revised regulations and model notices that take into account that COBRA will exist side-by-side with the insurance "marketplaces." As far as I can see, we aren't supposed to use the new notices yet. Comments can be submitted until July 1, 2014 and presumably, we'll have final notices available shortly thereafter.
